Terms of Use - sk.cloud

1. Basic Description and Functionality

The sk.cloud application serves to provide information about the Government Cloud of the Slovak Republic and mediates access to relevant documents, information, and instructions. The application consists of a publicly accessible information website and a private zone for Government Cloud users.

2. Service Controller

The controller of the sk.cloud service is the Ministry of the Interior of the Slovak Republic (MV SR), with its registered office at Pribinova 2, 812 72 Bratislava – Staré Mesto district, Company ID No. (IČO): 00151866.

3. Liability for Damage and Compensation for Damage

The sk.cloud service is provided "as is" without any express or implied warranty. The Controller shall not be liable for damage arising from the use, inability to use, or functionality of the application and its content. The content is provided for informational purposes and without any warranty of correctness, completeness, or timeliness. The Controller shall not be liable for damage caused by the incorrect or unauthorised use of the application or its content.

In particular, the Controller shall not be liable for:

  • damage arising as a result of exceeding the capacity range, failure, repair, or maintenance of the infrastructure, network, or part thereof,
  • damage arising (even partially) through the fault of the User,
  • lost profit or non-material damage,
  • any damage caused to the User as a result of an internet network outage, delayed delivery or restriction, interruption, or loss of availability, integrity, or confidentiality of data, including personal data.

Notwithstanding any other provisions in these Terms of Use – sk.cloud, in the event of failure to provide access through the sk.cloud application, the liability of the Controller is limited solely to the obligation to promptly remedy the defect. The Controller is therefore not obliged to pay Users compensation for damage as a result of failure to provide access through the sk.cloud application, or defective provision of access through the sk.cloud application.

The User is liable for damage incurred by the Controller for any reason on the part of the User, and this to the full extent. Likewise, the User is liable for any user whom the User, intentionally or through negligence, enabled to cause such damage, and this to the full extent.

The User is liable to the Controller to the full extent also for damage caused by a user to whom they, intentionally or through negligence, enabled access through the sk.cloud application.

In the event that the Controller proves the damage, the User shall pay it in full within 30 (thirty) calendar days from the date of delivery of the request for compensation for damage, by bank transfer to the Controller's account.

4. Intellectual Property Rights

The sk.cloud application, including its content, is protected by the intellectual property right licences of the Controller and/or its licensors, which are protected under the applicable legal regulations (hereinafter also "intellectual property rights"). The Controller and/or its licensors reserve all property rights to the sk.cloud application and its content, including all related intellectual property rights.

The User does not acquire any intellectual property rights to the sk.cloud application, including its content, which consists of documents, information, materials, methodologies, instructions, catalogues, software, PDF outputs, etc.). The User must not use information obtained by creating a reproduction of the sk.cloud application or by creating its reverse translation for a) achieving an objective other than achieving the interoperability of the sk.cloud application with an independently created computer program, b) providing it to other persons, except where this is necessary to ensure the interoperability of the sk.cloud application with an independently created computer program, c) ensuring the development, production, or trading of a computer program that is similar in its expression, or for any other activity that would infringe the rights of the Controller or its licensors.

The User shall indemnify the Controller and its supplier(s) for all third-party claims, damages, liabilities, and harm (including reasonable legal representation fees and costs) incurred by the Controller or its supplier(s) in connection with the use of the sk.cloud application, in particular in the event that the User uses the sk.cloud application for unlawful purposes or infringes the intellectual property rights of a third party.

The dissemination, public display, modification, translation, or other use of any parts of the sk.cloud application, including the materials constituting its content (e.g., documents, information, materials, methodologies, instructions, catalogues, software, PDF outputs, etc.), without the prior written consent of the controller is prohibited, in particular dissemination to third parties or use for purposes other than those intended.

5. Purpose of Use

All documents and content available in the sk.cloud application are intended exclusively for authorised users of the Government Cloud of the Slovak Republic. The content must not be used for commercial, marketing, or other purposes without the express consent of the controller.

6. Registration and Account Management

  • Registration to the private zone is possible exclusively through approved email domains and must be manually confirmed by an administrator.
  • The User is obliged to provide truthful and current data.
  • The User may request the deletion of the account by sending a request to the address: cloudinfo@minv.sk.
  • The Controller reserves the right to cancel or restrict a user's access to the service (in particular, but not exclusively, for violation of the terms or principles of use).

7. Cookies

The application uses cookies exclusively to ensure basic functionality and for authentication purposes. The website also uses third-party cookies within the reCAPTCHA v2 (Google) service, which serve to protect against spam forms.
